1. Acceptance of Terms
By accessing or using FareFalcon ("FareFalcon," "we," "our," or "us") at farefalcon.com or any related service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
2. Description of Service
FareFalcon is a post-booking travel optimization service that monitors flight reservations you provide and sends you notifications when a Flight Price Drop Opportunity is detected, meaning the current market price for your specific itinerary has dropped below the amount you paid.
FareFalcon is an informational service. We provide alerts and information about potential savings opportunities. We do not book, cancel, modify, or rebook any travel reservation on your behalf. All actions taken in response to FareFalcon alerts, including contacting your airline, requesting credits, and rebooking, are taken solely by you.
FareFalcon is not affiliated with any airline, hotel chain, car rental company, or other travel provider.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. User Accounts and Waitlist
To access the full Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@farefalcon.com if you suspect unauthorized access.
Joining the waitlist does not create an account or guarantee access to the Service. We reserve the right to decline any waitlist registration or revoke access at any time.
5. Your Reservation Data
You grant FareFalcon a limited, non-exclusive license to use your reservation data (flight details, confirmation numbers, travel dates, and paid prices) solely for the purpose of providing the Service, specifically monitoring prices and delivering alerts.
You represent and warrant that you have the legal right to provide any reservation data you submit to FareFalcon and that doing so does not violate any third-party rights or agreements.
FareFalcon does not use your reservation data to book, cancel, or modify travel on your behalf. You retain full ownership of and responsibility for your reservation.
6. Accuracy of Information
FareFalcon makes no representations or warranties regarding the accuracy, completeness, or timeliness of price data or opportunity alerts. Flight prices and airline policies change frequently. A price drop detected by FareFalcon may no longer be available by the time you act on an alert.
FareFalcon alerts are for informational purposes only. Always verify current prices and applicable airline policies directly with your airline before taking any action.
7. No Guarantee of Savings
FareFalcon does not guarantee that you will receive any specific savings, that any price drop opportunity will be actionable, or that you will receive any alerts during the period your reservation is monitored. The frequency and magnitude of price drops vary by route, airline, booking class, and market conditions.
Actual savings depend on airline policies (change fees, credit issuance, rebooking eligibility), the timing of your action relative to the alert, and other factors outside FareFalcon's control.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Submit false or misleading reservation data or personal information
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Use automated tools, bots, scrapers, or scripts to access the Service in a manner that imposes an unreasonable load on our infrastructure
- Resell, sublicense, or otherwise transfer access to the Service without our express written consent
9. Intellectual Property
The Service, including its design, software, content, and branding, is owned by FareFalcon and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it as described herein.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
FAREFALCON DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT DEFECTS WILL BE CORRECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAREFALCON AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF SAVINGS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FAREFALCON'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FAREFALCON IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless FareFalcon and its officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service or your violation of these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature within the Service. Upon termination, your right to use the Service ceases immediately.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FareFalcon with respect to the Service and supersede all prior agreements and understandings.
